SMILE GIVE AWAY CONTEST RULES

1. Introduction: Advantage Dentistry is offering this online contest. NO PURCHASE NECESSARY TO WIN. A PURCHASE DOES NOT IMPROVE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED. Participation constitutes participant's full and unconditional agreement to and acceptance of these Official Rules.

This contest may only be entered in or from New York State. Entries originating from any other jurisdiction are not eligible for entry. This contest is governed exclusively by the laws of the United States and New York State. You are not authorized to participate in this contest if you are not located within New York State.

2. Eligibility: Open to individuals who are legal residents of New York State who are 18 years of age or over as of the date of entry.

3. Start/End Dates: Contest begins Monday, September 20, 2010 at 9:00:01 a.m. and ends Monday, December 20, 2010 at 10:00:00 p.m. Prizes must be claimed by December 31, 2010. For purposes of these Official Rules, all times are based on New York City Time (EST).

4. Sponsor: This contest is sponsored by Advantage Dentistry, with two locations: 2887 Elmwood Avenue, Kenmore, New York 14217; and 1909 Pine Avenue, Niagara Falls, New York 14301 (the "Sponsor"). Employees or agents of the Sponsor and their respective parent companies, affiliates, subsidiaries, advertising/promotional agencies, providers, suppliers and the members of their immediate families or those persons living in the same household of such individuals are ineligible to enter or win. All Federal, state and local rules and regulations apply. Void where prohibited or restricted by law.

5. How to Enter: Each potential contestant will receive a flyer in the mail containing a unique number to enter on the Sponsor's web site: http://www.advantagedentistry.com . Contestants will be notified instantly whether or not they won. Online entries must be received before 10:00 p.m. EST, Friday, December 31, 2010. Only one entry per person, per e-mail address per day is permitted. All entries become the exclusive property of Sponsor and will not be acknowledged or returned. Any use of robotic, automatic, programmed or the like entry methods will void all such entries by such methods.

E-MAIL CHANGE OF ADDRESS POLICY: It is the sole responsibility of the participant to notify the Sponsor in writing if the participant changes his/her e-mail address. The Sponsor and its agencies are not responsible for lost, interrupted or unavailable network, server or other connections, miscommunications, failed phone or computer hardware or software or telephone transmissions or technical failures, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical or electronic; including without limitation the incorrect or inaccurate capture of entry information online, or for lost, late, incomplete, damaged, destroyed, delayed, stolen, misdirected or illegible entries. Entry materials/data that have been tampered with or altered are void. Once submitted, entries become the sole property of the Sponsor and will not be returned. In case of dispute as to identity of a winner, such entry will be declared made by the registered user of the e-mail account at the time the entry was submitted, and if a prize is won, and such registered user is a valid participant, the prize will be awarded to such registered user.

6. Prizes: The following prizes will be awarded:

Total value of prizes: $3,000.00 - $3,500.00. No alternative prize, cash, or other substitution is permitted except by the Sponsor in the event of prize unavailability. All federal, state, and local taxes are the sole responsibility of the winner, who will receive an IRS Form 1099 reflecting the final actual value of any prize valued at $600 or more.

7. Winners: Winner will be determined randomly through an automated or mechanical process once his or her unique code is entered into the computer. All decisions of the Sponsor are final and binding. Odds of winning depend on the number of eligible entries received. The winner will be notified immediately upon entering the unique code. Winners must claim their prizes no later than one week after the end of the competition (no later than December 22, 2010). Winners can claim their prizes by notifying Sponsor via email at Advantage.Dentistry@yahoo.com or addentnf@choiceonemail.com or at Advantage Dentistry, 2887 Elmwood Avenue, Kenmore, New York 14217; or 1909 Pine Avenue, Niagara Falls, New York 14301. Sponsor is not responsible for and shall not be liable for any late, lost, or misdirected notification, or for winner's unsuccessful efforts to claim any prize.

Winner may be required to sign and return a release of liability, declaration of eligibility, and where lawful, a publicity consent agreement, all within 10 days of acknowledged notification. By accepting and/or using prize, the winner agrees to the use of his/her name, voice and/or likeness for the purpose of advertising, trade, or promotion without further compensation, unless prohibited by law. If a selected winner cannot be contacted, is ineligible, fails to claim a prize, or fails to timely return the completed and executed declaration and releases as required, the prize may be forfeited and an alternate winner will be selected. In the event of a dispute regarding who submitted an online entry, the entry will be deemed submitted by the authorized account holder of the e-mail account.

8. General Terms and Conditions: By entering, each participant agrees to be bound by these Official Rules and the decisions of Sponsor, which shall be final. Sponsor, agents and representatives of Sponsor, its parent companies, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, unintelligible, or postage-due winning notifications; (ii) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (iii) failed, incomplete, garbled, or delayed computer transmissions; (iv) any condition caused by events beyond the control of the Sponsor that may cause the Contest to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the Contest; or (vi) any printing or typographical errors in any materials associated with the Contest. Sponsor and Released Entities reserve the right to correct typographic, clerical or printing errors in any Contest materials. Sponsor and Released Entities are not responsible for any typographical or other error in the printing of this Contest, the administration of the Contest or in the announcement of Prize Winner(s), including such error as may give an erroneous indication that a prize has been won. Sponsor reserves the right, in its sole discretion, to suspend or cancel Contest at any time if a computer virus, bug, or other technical problem corrupts the administration, security, or proper play of the Contest.

In the event the Sponsor or Released Entities are prevented from continuing with this Contest, or the integrity and/or feasibility of the Contest is undermined by any event including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute, or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state, provincial or local government law, order of regulation, order of any court or jurisdiction, or other cause not reasonably within the Sponsor's or Released Entities' control (each a ’ÄúForce Majeure" event) the Sponsor and Released Entities shall have the right, in their sole discretion, to abbreviate, modify, suspend, cancel or terminate the Contest without notice or further obligation. If the Sponsor or Released Entities, in their discretion, elect to abbreviate, cancel or terminate the Contest as a result of a Force Majeure event, the Sponsor and Released Entities reserve the right, but shall have no obligation, to award the prize from among all valid and eligible entries received up to the time of such Force Majeure event.

CAUTION: ANY ATTEMPT BY AN PARTICIPANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR(S) RESERVE(S) THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

By participating in the Contest, each participant agrees to release and hold Sponsor and the employees, officers, directors, shareholders, agents, representatives of Sponsor, its parent companies, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the Contest or resulting from acceptance, possession, or use of any prize, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy.

Sponsor will have right to photograph winner. Entry constitutes permission to winner's name, picture, likeness, and city and state of residence for purposes of trade, publicity or promotion for no additional compensation except where prohibited by law. By participating, participants, winner(s) agree to release and hold harmless Sponsors, and their respective parent companies, subsidiaries, affiliates, advertising and promotions agencies, partners, representatives, agents, successors, assigns, employees, officers and directors, from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in Contest, or possession, acceptance and/or use or misuse of prize or participation in any Contest-related activity and for any claims based on publicity rights, defamation or invasion of privacy and merchandise delivery. Sponsors are not responsible if Contest cannot take place or if [any] prize cannot be awarded due to travel cancellations, delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism.

9. Affidavit of Eligibility/Release: The winner will be required to execute an Affidavit of Eligibility, a Liability Release and where lawful, a Publicity Release within [14] days of prize notification. If the winner cannot be contacted within one (1) calendar day of first notification attempt, if prize or prize notification is returned as undeliverable, if winner rejects his/her prize or in the event of noncompliance with these Contest rules and requirements, such prize will be forfeited and an alternate winner will be selected from all remaining eligible entries. Upon prize forfeiture, no compensation will be given. [Limit one prize per person or household].

10. Dispute Resolution: Any and all disputes and claims relating to this promotion shall be resolved through binding arbitration under the laws of the State of New York.

11. 12. Proof of Age, Identity and Eligibility: Each Winner, upon request of the Sponsor, must supply documented proof of age, identity and eligibility within 2 business days of being contacted by Sponsor. Failure to do so will result in forfeiture of the prize. At such time, if such forfeiture occurs, Sponsor may select an alternate Winner at random from all remaining eligible entries in the corresponding entry pool.

13. Use of Data: Sponsor will be collecting personal data about participants online in accordance with the following privacy policy. By participating in the Contest, participants hereby agree to Sponsor's collection and use of their personal information and acknowledge that they have read and accepted Sponsor's privacy policy.

PRIVACY POLICY: The information that you provide in connection with the contest is collected by Sponsor and may be used for Sponsor's internal purposes and to send you information about Sponsor's products and special promotions but will not be provided to third parties, except as necessary for the administration of the Contest or as required by law or legal process. This information will be used for promotional purposes but will not be used for the purposes of providing medical treatment. This information includes, but is not limited to, participant's name, address, phone number, email address, contact preferences, and IP address of the computer participant uses to enter the contest. Collection of sensitive information, such as phone number, is optional. However, obtaining such contact information can facilitate the distribution of prizes. Personal information collected online may be supplemented with information you provide to Sponsor through other Sponsor services. This information is collected when Participant inputs said information, and also through the use of cookies.

Entry constitutes permission to post winner's name on Website and to use winner's name, hometown and/or likeness for purposes of advertising and promotion without further compensation unless prohibited by law. If you do not wish to receive information from Sponsor in the future, please make sure to uncheck the appropriate box on the Official Entry Form.

14. Severability: The provisions of this Agreement shall be severable, and if any provision shall be prohibited by law, or invalid, or unenforceable in whole or in part for any reason, the remaining provisions shall remain in full force and effect.
